Tell the White House: Ban Biased Profiling

The Department of Justice (DOJ) and the Department of Homeland Security (DHS) are targeting Americans for suspicion and investigation on the basis of race, religion, and ethnicity. Much of this profiling is permissible under the agencies’ current rules.

One year ago, President Biden directed these departments to update their policies on when and how to account for race, religion, gender, and other such traits in their operations. Now, we must ensure that the new policies close all loopholes and fully ban discriminatory profiling.

Federal rules still allow racial profiling by the Department of Justice and Department of Homeland Security. One year ago, the Biden administration charged DOJ and DHS with revising these policies. It now must take the next step and ban discriminatory profiling in every form.

1. The new policies must fully ban profiling based on race, ethnicity, religion, national origin and nationality, disability, gender, and sexual orientation.

2. These policies must cover all of the departments’ operations, closing the loopholes that allow profiling to continue in national security, intelligence, and immigration work. There should be no area in which protections against bias are cast aside.

3. These policies must be implemented without equivocation, with specific requirements for measuring the impact of investigations, training officials, and disciplining those who do not comply.
